"Nicht geschlechtergerechte Berufungsverfahren sind rechtswidrig. Wenn Frauen in Berufungsverfahren keine oder nur geringere Chancen haben, dann ist dies nicht nur Ausdruck einer geschlechtsspezifischen Diskriminierungskultur im Hochschulwesen, sondern auch ein rechtliches Problem. Einige Gerichtsurteile über die Rechtmäßigkeit von Berufungsverfahren bieten Paradebeispiele für Verfahrensfehler, die zumeist zu Lasten von Frauen wirken. Obwohl Frauen sich erfolgreich auf Art. 33 II GG berufen konnten, findet das Prinzip der Bestenauslese in der Diskussion um geschlechtergerechte Berufungsverfahren nur unzureichend Beachtung. "Non-gender-equality appointment procedures are unlawful. If women have no or less chance of being given a professorship than men, then that is not only an expression of the climate of gender discrimination within the university system, it also becomes a legal issue. Some court decisions concerning the lawfulness of such appointment procedures are prime examples of procedural errors that place women academics at a disadvantage. Although women have successfully relied on article 33 para. 2 of the Basic Law (Grundgesetz), this provision has not been taken seriously in the discussion of the gender-equality appointments of professors. The binding nature of job profiles that have come up in court cases raises questions about how to deal with flawed calls for applications." (author's abstract)... view less
