Statistische Auswertung von Atem- und Blutalkoholkonzentrationen anhand von 1000 in der Praxis ermittelten Datensätzen

  • Es wurden 1000 von der Polizei in und um Frankfurt am Main in der Praxis ermittelte AAK-Messwerte und die entsprechenden BAK, die im Zentrum der Rechtsmedizin der Johann Wolfgang Goethe-Universität in Frankfurt am Main bestimmt wurden, einer statistischen Auswertung unterzogen. In die Auswertung sind alle aus den Untersuchungsunterlagen entnehmbaren Parameter, wie Geburtsdatum der Probanden, Geschlecht, Datum und Uhrzeit der AA-Entnahme, AAK, Datum und Uhrzeit der Tat, zuständiges Polizeirevier, AAK-Messgerät, BAK, Datum und Uhrzeit der Blutentnahme, eingeflossen. Die statistische Auswertung hat ergeben, dass die durchschnittliche Differenz aller AAK- und BAK-Werte bei -0,02 Promille liegt, mit einer Standardabweichung von ±0,35 Promille bei einer maximalen Differenz von -1,13 Promille nach unten und +2,81 Promille nach oben. Die Standardabweichung von ±0,35 Promille wurde als Grenzwert zur Überprüfung der Korrelation der wahrscheinlichen BAK zum Zeitpunkt der AAK-Bestimmung gewählt. Trotz der großen Spanne des Grenzbereichs von 0,7 Promille wurden nur 77,9% der AAK-BAK-Paare als korrelierend ermittelt. Bei Festlegen individueller Grenzwerte, gebildet aus der minimalen bzw. der maximalen BAK zum Zeitpunkt der AAK-Bestimmung, erwiesen sich nur noch 34,7% der Wertepaare als korrelierend. Der durchschnittliche BAK-AAK-Quotient betrug 1:2181, mit einer Standardabweichung von ±1:473. Die Quotientenspanne lag zwischen 1:0 und 1:4480. Als einziger, eindeutig nachzuweisender Faktor für die Beeinflussung der AAK-Messwerte galt die tatsächliche Höhe der BAK. Je höher die Probanden-BAK war, umso größer waren die AAK-Abweichungen von der BAK. Erwähnenswert ist, dass die AAK-Messgeräte der Firma Dräger (Alcotest® 7310 und 7410), auf Redox-Halbleiter-Gassensoren aufbauend, die indirekte BAK im Durchschnitt zu hoch, während die Brennstoffzellen-Geräte LMB S-D3 der Firma LMB Laborservice GmbH die indirekte BAK im Durchschnitt zu niedrig angaben. Die Untersuchung der Wertepaare aus AAK und minimaler BAK zum Zeitpunkt der AAKBestimmung im Vergleich zu den vom Gesetzgeber vorgegebenen Promille-Stufen für ein bestimmtes Strafmaß (0,3 Promille, 0,5 Promille, 0,8 Promille, 1,1 Promille, 1,6 Promille, 2,0 Promille, 3,0 Promille) hat ergeben, dass bei dem vorliegenden Datenmaterial 203 Probanden eine zu niedrige und 239 Probanden eine zu hohe Strafe erhalten hätten, wenn die AAK als alleiniges Maß verwendet worden wäre. Diese Fehleinschätzung wäre eingetreten, weil die AAK der Probanden über bzw. unter den oben genannten Grenzwerten lag und sich ihre BAK umgekehrt unter bzw. über denselben Werten befand. Es lässt sich feststellen, dass eine Berechnung der BAK aus dem Ethanolgehalt der Atemluft nicht möglich ist, weil viele Faktoren die AAK-Messung beeinflussen, die bisher unberücksichtigt blieben und auch von modernen, hochpräzisen AAK-Messgeräten schwerlich erfasst werden können. Daher gilt die Empfehlung, die AAK-Messung nur als Vorprobe und zum Screening zu verwenden. Bei juristischen Begutachtungen sollte nur die BAK verwendet werden, weil diese als einziger Wert präzise und beweissicher ist und außerdem über den Trunkenheitszustand eindeutig informiert. Betroffene sollten auf jeden Fall auf einer BAK-Untersuchung bestehen und die AAK als Messwert in Frage stellen.
  • 1000 measured RAC values and the corresponding BAC values were taken by the police in practice in and around Frankfurt am Main, and were analysed and statistically evaluated at the forensic medicine centre of the Johann Wolfgang Goethe University in Frankfurt am Main. The evaluation incorporated all the parameters available from the investigation documents such as the date of birth of the probands, their sex, the date and time the RA measurement was taken, the RAC value, the date and time of the offence, the responsible police station, the RAC measuring device used, the BAC value, and the date and time a blood sample was taken. The statistical evaluation showed that the average difference between all the RAC and BAC values lies at -0.02% with a standard deviation of ±0.35% and a maximum difference of -1.13 % below and +2.81% above. The standard deviation of ±0.35% was chosen as the limiting value for checking the correlation of the probable BAC at the time the RAC was determined. Despite the large span of the limiting range of 0.7%, only 77.9% of the RAC-BAC pairs were found to correlate. When determining individual limiting values formed from the minimum or maximum BAC at the time the RAC was determined, only 34.7 of the pairs of values were found to correlate. The average BAC-RAC quotient was 1:2181, with a standard deviation of ± 1:473. The quotient spread lay between 1:0 and 1:4480. The only clearly verifiable influencing factor on the measured RAC values was the actual level of the BAC. The higher the value of the probands' BAC the greater the RAC deviations from the BAC. It is worth mentioning that on average the RAC measuring equipment (breathalysers) of the firm Dräger (Alcotest® 7310 and 7410), which are based on redox semi- conductor gas sensors, gave too high indirect BAC values while on average the LMB SD3 fuel cell breathalysers of the firm LMB Laborservice GmbH gave too low indirect BAC values. Examination of the pairs of values consisting of the RAC and the minimum BAC at the time the RAC was determined compared to the legal alcohol limit levels in parts per thousand for specific penalties and sentences (0.3, 0.5, 0.8, 1.1, 1.6, 2.0 and 3.0 per mil) showed that in the case of the data available from this study, if the RAC had been used as the sole parameter 203 probands would have received too low a penalty and 239 probands too high a penalty. This faulty assessment would have occurred because the probands' RAC values lay above or below the aforementioned limiting values and conversely their BAC values lay below or above the same values. It can be concluded that it is not possible to calculate the BAC from the ethanol content of a person's breath because many factors influence the RAC measurement, which to date have not been taken into consideration and are difficult to record even using modern, highprecision breathalyser equipment. Therefore the recommendation is that the RAC measurement is only used as a quick test or preliminary sample and for screening. Legal expert examinations should only use the BAC because this is the only value which is precise and which can be reliably used as evidence and in addition it provides clear information about the intoxicated condition. Those affected should always insist on a BAC examination and question the validity of the RAC as a measured value.
