Zusammenfassung
Warum Menschen mit Migrationshintergrund (MH) delinquent werden, ist eine Frage, die gesellschaftlich intensiv diskutiert wird und durch die hohe Diversität der Straffälligenpopulation auch kriminalpolitisch sehr bedeutsam ist. Bislang gibt es jedoch kaum Kriminaltheorien, die systematisch Migrationsstressoren und Aspekte der kulturellen Sozialisation betrachten. Die vorliegende Studie untersuchte deshalb gezielt subjektive Ursachenzuschreibungen für Delinquenz bei Menschen mit türkischem oder arabischem MH. Angelehnt an die Delphi-Methode wurden zunächst Interviews mit forensischen Experten durchgeführt, die selbst einen MH haben. Mit einem daraus abgeleiteten Fragebogen wurden in dieser Arbeit 128 forensische Experten, welche als Sachverständige im Strafrecht, im Strafvollzug oder in der Bewährungshilfe tätig waren, zu möglichen Ursachen für Delinquenz bei Personen mit türkischem oder arabischem MH befragt.
Es zeigt sich, dass eine Vielzahl von Merkmalen aus unterschiedlichen Lebensbereichen und in unterschiedlichen Entwicklungsabschnitten als Risikofaktoren angesehen werden. Dabei werden migrations- und kultursensible Merkmale insgesamt für genauso wichtig gehalten wie Risikomerkmale aus gängigen Kriminaltheorien. Ein Erklärungsansatz, der aus einer Hauptkomponentenanalyse des Datensatzes resultiert, integriert neben gängigen Risikofaktoren (z. B. desorganisierte Nachbarschaft) eigenständige Faktoren, die Risiken durch die kulturelle Sozialisation (z. B. traditionelle Ehrvorstellungen und Abgrenzung von der Aufnahmegesellschaft) bzw. Migrationsstressoren (z. B. Diskriminierungserleben und Wertekonflikte) beinhalten. Ein Verfahren, welches gängige Prädiktoren und migrations- sowie kultursensible Aspekte vereint, könnte in Zukunft nicht nur die Güte von Kriminalprognosen verbessern, sondern auch zu einer kultursensiblen Ausrichtung von Präventions- und Interventionsmethoden beitragen.
Abstract
The question why people with a migration background (MB) become delinquent, is an ongoing issue in society. This issue is also important to criminal policy because offender populations are highly diverse; however, until now criminological theories which systematically consider aspects of migration and culture are rare. Thus, we explicitly studied subjective causes of delinquency among people with a MB from Turkey and Arabic countries. According to the Delphi method we first conducted interviews with forensic experts having a MB themselves. Afterwards 128 forensic experts, who were working as court experts, in prisons or for the probation service, filled out a questionnaire about potential causes of delinquency among people with a MB from Turkey or an Arabic country. As a result, many different variables relating to various aspects of life and different stages of development were rated as risk factors. Thereby, risk factors that are sensitive to migration and culture were evaluated as being just as important as common risk factors that were taken from well-known criminological theories. The present data were used in a principal component analysis that yielded a new approach for explaining delinquency. This approach integrates common risk factors (e. g. a disorganized neighborhood) as well as autonomous factors containing aspects of culture (e. g. traditional honor norms and delimitation from the host society) and migration (e. g. experienced discrimination and conflict of values). A method which combines common risk factors and risk factors sensitive to migration and culture may improve the validity of risk assessments in the future. Furthermore, such an approach might contribute to a culture sensitive adaptation of prevention and intervention methods.

Die Interviewten waren in den Bereichen soziale Arbeit bzw. Jugend‑/Bewährungshilfe, Wissenschaft, Sachverständigentätigkeit für kriminalprognostische Fragestellungen, Strafvollzug, Polizei und Psychotherapie tätig, wobei die Hälfte der Experten Psychologen waren, die andere Hälfte Sozialpädagogen.

Die hier angewendeten varianzanalytischen Verfahren sind zwar sehr robust gegenüber der Verletzung der Normalverteilungsvoraussetzung (Bortz 2005), dennoch wurden alle Vergleiche mit nichtparametrischen Tests (Mann-Whitney-U-Test) wiederholt, was zu den gleichen Ergebnissen führte.
