Die “Festung der Freiheit” und der “Wind der Wörter” oder: Die Kunst der Rede und das Prinzip des Rechts. Zum Verhältnis von Humanismus und Jurisprudenz in Gregor Heimburgs Konzilsappellation (1461) gegen Pius II.

Zusammenfassung

In seiner Denkschrift (Januar 1461) rechnet Gregor Heimburg nicht nur persönlich mit seinen Feinden (Pius II., Nicolaus Cusanus) ab, sondern sucht audi den Vorrang der Jurisprudenz und ihrer kasuistischen Ethik vor der Schönen Literatur zu beweisen. Als Appellation “vom Papst an ein künftiges Generalkonzil” ist sie Rechtsinstrument im Prozeßgang, als “Flugschrift’ zugleich ein bemerkenswertes Dokument politischer Publizistik. Sie bezeugt die starke Nachwirkung konziliarer Theorien und ihrer vielfältigen Thematik (Nationalkirche, Konsenszwang, Repräsentationsbegriff, Widerstandsrecht, Freiheit) in der Propaganda und belegt den Einfluß humanistischer Ideen der ‘fahrenden Juristen’ des 15. Jahrhunderts. Das prekäre Verhältnis von Rhetorik und Recht ist ihr Hauptthema, dessen Behandlung aus der Einsicht des Verfassers entwickelt wird, daß die Wahrheit in alien Rechtsdingen schwerer wiege als das brillanteste Plädoyer.

Abstract

In his treatise of January 1461, Gregor Heimburg does not only balance his account with his adversaries (Pius II, Nicolaus Cusanus) but also seeks to prove the predominance of jurisprudence and its casuistic ethics over the claims of literature and poetics. As an appeal “from the Pope to a future General Council” the treatise is a means of legal redress in a trial, as a broadside it is a remarkable piece of political journalism. It evidences the strong impact of conciliar theories and their various topics (national church, compulsory consensus, the concept of representation, the right of resistance, the idea of liberty) in contemporary propaganda, and it manifests the shaping influence humanistic studies had on the politics of the ‘lawyers errant’ in the 15th century. The central concern of Heimburg’s pamphlet is the intriguing relationship between rhetorics and law, elaborated from the author’s conclusion according to which truth is to prevail over the brilliancy of pleading in all judicial affairs.
