Die Krise des liberalen Konsenses ist auch eine Krise des Rechtsstaates. Der Rechtsstaat entstand in langwierigen historischen Kampfzyklen als eine rechtsförmige Apparatur, die das neu entstandene staatliche Gewaltmonopol umfassend kontrollieren sollte. Dieses liberale, aber an den Nationalstaat gebundene Modell war lange Zeit hegemonial. Doch der Rechtsstaat ist erneut dynamisch umkämpft. Neoliberale Strategien zielen auf eine Umgehung rechtsstaatlicher Strukturen, national-konservative Ansätze verteidigen das territoriale Rechtsstaatsmodell gegen die Transnationalisierung und autoritäre Akteur:innen demontieren die Institutionen und Verfahren des Rechtsstaates. The crisis of the liberal consensus is a crisis of the rule of law (Rechtsstaat). The idea of the rule of law developed through long historical cycles of struggles as a juridical apparatus to control the monopoly of state power. The liberal model, which was tied to the territory of national states, has gained hegemony for a long time. But recently there is a new cycle of struggles over the rule of law. Neoliberal strategies try to circumvent the structures of the rule of law, national-conservative approaches defend the territorial model of the rule of law against processes of transnationalization and authoritarian actors dismantle the institutions and procedures of the rule of law. This paper analyzes the development of the political and juridical struggles around the rule of law and the actual cycle of struggles from a materialistic perspective.... view less
